These Terms of Service (the “Terms”) form a legal agreement between you (“Client,” “you”) and Roal Photography (“we,” “us,” “our”) governing your access to and use of the roal.photography website and its subdomains (the “Site”) and related services. By accessing or using the Site, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, do not use the Site.
You must be at least 18 years old to book Services. Bookings involving minors must be made and authorized by a parent or legal guardian.
You agree to use the Site only for lawful purposes. You may not: (a) copy, download, screenshot, or scrape watermarked proof photos; (b) remove, obscure, or alter any watermark or copyright notice; (c) use automated means to access the Site or harvest data; (d) attempt to access restricted areas or galleries that are not yours; or (e) interfere with the security or operation of the Site.
All Content on the Site is owned by Roal Photography or its licensors and is protected by copyright and intellectual property laws. Roal Photography retains full copyright in all photographs, including after delivery. Proof photos are displayed with a watermark solely for your selection and grant no usage license. The license to final images is described in the Session Agreement.
Galleries may be password-protected. You are responsible for keeping your link and password confidential and for all activity conducted through them. Galleries may expire after a period; we recommend downloading your final images promptly.
Bookings, deposits, balances, cancellations, and rescheduling are governed by the Session Agreement. Card payments are processed securely through Stripe; we do not store full card details.
The Site relies on third-party providers, including Stripe (payments), Resend (email), Supabase (database), and Cloudflare (hosting). Your use of those services is subject to those providers’ policies. We are not responsible for the acts or omissions of third parties.
The Site and its Content are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.
To the maximum extent permitted by law, Roal Photography will not be liable for indirect, incidental, special, consequential, or punitive damages. Our total aggregate liability relating to the Site or Services will not exceed the amount you paid for the applicable Services.
You agree to indemnify and hold Roal Photography harmless from any claims, losses, or expenses (including attorneys’ fees) arising from your breach of these Terms or misuse of the Site or Services.
We may suspend or terminate your access to the Site or a Gallery if you breach these Terms, without prejudice to any other rights available to us.
We may modify these Terms at any time. The current version is identified by the “Last updated” date. Continued use of the Site after a change constitutes your acceptance of the revised Terms.
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Florida, and you consent to their jurisdiction.
If any provision of these Terms is held invalid, the remaining provisions will remain in effect. These Terms, together with the Privacy Policy and Session Agreement, constitute the entire agreement between the parties.
