This Session Agreement (the “Agreement”) governs photography sessions booked with Roal Photography (“we,” “us,” “our”). By booking a session or accepting these terms, you (“Client,” “you”) agree to be bound by this Agreement.
A 50% non-refundable deposit is required to reserve and confirm your session date. Your date is not held until the deposit is received. The deposit is applied toward your session total.
The remaining balance is due on the day of the session, prior to it starting, unless otherwise agreed in writing. Card payments are processed through Stripe. Late payments may delay the session or delivery of images.
You may reschedule once with at least 48 hours’ notice, subject to availability. The deposit is non-refundable in all cases. Cancellations with less than 48 hours’ notice, or no-shows, may require a new deposit to rebook.
Session time begins at the booked start time. Late arrivals shorten the session and do not entitle you to an extension or refund.
We bring our artistic vision to each session. Final image selection and editing style are at our professional discretion. Editing is included per your booked package; requests for extensive retouching or work outside our style may incur an additional fee. We do not deliver unedited (RAW) files.
Proof photos are posted to your online gallery for you to select which images to edit per your package. Edited images are delivered through the gallery within the estimated turnaround stated at booking. Turnaround times are good-faith estimates and may vary during busy seasons.
Roal Photography retains copyright in all images. Upon receiving your edited images, you are granted a limited, non-exclusive, non-transferable license for personal use: to print, display, and share your photos. You may not sell, license, use commercially, enter into contests, or re-edit, crop, or apply filters to delivered images, as this alters the photographer’s style. Credit is appreciated when sharing on social media.
With your separate consent, we may use your images in our portfolio, website, and social media. This consent is optional for paying clients and required for bookings made with a promo code. You may request in writing that a specific image not be used before it is published.
We make reasonable efforts to back up files but do not guarantee permanent storage. We recommend downloading and backing up your final images promptly. We may archive or delete files after a period.
If, due to illness, equipment failure, weather, or other circumstances beyond our reasonable control, we cannot perform the session, we will make reasonable efforts to reschedule; if that is not possible, our sole liability will be a refund of amounts paid for the unperformed session. To the maximum extent permitted by law, our total liability will not exceed the amount paid for the session.
You are responsible for your conduct and that of your guests during the session, and for obtaining any permits required at your chosen location. We are not responsible for injury, loss, or damage occurring during the session.
You agree to indemnify and hold Roal Photography harmless from third-party claims arising from the session, including property damage or injury caused by you or your guests.
We reserve the right to end a session for inappropriate, abusive, or unsafe conduct, without refund.
This Agreement is governed by the laws of the State of Florida, USA. If any provision is held invalid, the remaining provisions will remain in effect. This Agreement, together with the Terms of Service and Privacy Policy, constitutes the entire agreement regarding your session.
